TERMS AND CONDITIONS OF SERVICE

1. AGREEMENT TO TERMS

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("Customer", "Shipper", "You") and BH Home Solution Group d/b/a Olympic Auto Transport ("Company", "Broker", "We", "Us"), located at 2552 NE Miami Gardens Dr. #206, Miami, FL 33180.

By booking a service with Olympic Auto Transport, you acknowledge that you have read, understood, and agree to be bound by all of these Terms and Conditions.

2. BROKERAGE SERVICE ONLY

Customer acknowledges and agrees that Olympic Auto Transport is a registered transportation BROKER (arranger of freight) and NOT a Motor Carrier (transporter).

• Role: Our sole responsibility is to locate and contract a licensed and insured Motor Carrier to transport your vehicle.
• No Possession: We never take physical possession, custody, or control of your vehicle.
• Carrier Liability: The Motor Carrier is solely responsible for the actual transport, including any damage to the vehicle, theft, or delays. Customer agrees to hold Olympic Auto Transport harmless from any claims regarding the physical transport of the vehicle.

3. CANCELLATION AND REFUND POLICY

Our cancellation policy is strictly enforced to protect the administrative work we perform in locating a carrier for you.

• Refundable Period: You may cancel your order for a full refund of your deposit/broker fee if you notify us in writing at least seven (7) days prior to your first available pick-up date AND before a carrier has been assigned.
• Non-Refundable Event: Once a Carrier has been assigned to your order (dispatched) and we have notified you of this assignment, the Broker Fee (Deposit) is NON-REFUNDABLE. At this stage, we have fully performed our service obligations by locating a carrier.
• Refusal of Service: If the Customer refuses to release the vehicle to the assigned Carrier for any reason (including refusing to pay the Carrier's balance), the Broker Fee remains non-refundable.

4. PRICING AND PAYMENT

• The Quote: The initial price provided is an estimate based on the information provided by the Customer.
• Price Adjustments: Olympic Auto Transport reserves the right to adjust the price if the vehicle details provided are incorrect (e.g., vehicle is larger than stated, modified, lifted, or inoperable) or if market conditions require a higher rate to secure a carrier.
• Customer Approval: If a price adjustment is necessary, we will contact you for approval. If you do not agree to the new price, you may cancel subject to the terms in Section 3.
• Broker Fee: The Broker Fee (Deposit) represents our compensation for service and is charged when we locate a carrier or as agreed upon booking.
• Carrier Pay: The remaining balance (Carrier Pay) is due directly to the driver upon delivery, payable in Cash, Money Order, or Cashier's Check only. Personal checks and credit cards are generally not accepted by drivers.

5. INOPERABLE VEHICLES

• Definition: A vehicle is considered "Inoperable" if it cannot be driven on and off the trailer under its own power safely (e.g., dead battery, flat tires, brake issues, no keys).
• Disclosure Requirement: Customer MUST disclose if a vehicle is inoperable at the time of booking.
• Non-Disclosure Fee: If a carrier arrives and the vehicle is inoperable but was listed as running, the Customer will be charged an additional fee (typically $150.00 - $200.00) payable to the Carrier. If the carrier cannot load the inoperable vehicle, a "Dry Run" fee may apply, and the Broker Fee will be forfeited.

6. PERSONAL ITEMS IN VEHICLE

• Weight Limit: Customers may place up to 100 lbs of personal items in the trunk of the vehicle ONLY.
• Liability: Neither Olympic Auto Transport nor the Motor Carrier is responsible for any personal items left in the vehicle. Personal items are NOT covered by the Carrier's insurance.
• Prohibited Items: Under no circumstances may the vehicle contain firearms, hazardous materials, illegal substances, or high-value items (cash, jewelry, electronics).
• Overweight Fee: If the personal items exceed 100 lbs, the Carrier reserves the right to charge an additional fee (determined by the driver) or require the items be removed before transport.

7. PICKUP AND DELIVERY TIMES

• Estimates Only: All pickup and delivery dates and times are estimates only. While we strive to meet your schedule, delays may occur due to weather, traffic, road conditions, or mechanical breakdowns.
• No Guarantees: Olympic Auto Transport does not guarantee a specific delivery date or time. We are not liable for rental car fees, accommodation costs, or loss of wages due to delays.

8. DAMAGE CLAIMS

• Inspection: The Customer (or their agent) and the Driver must inspect the vehicle at both pickup and delivery. Any damage must be noted on the Bill of Lading (BOL) at the time of delivery and signed by both parties.
• Filing a Claim: If damage occurs, the Customer must file a claim directly with the Motor Carrier's insurance provider. Olympic Auto Transport will assist by providing carrier insurance information but is not liable to pay for damages.
• Waiver: Failure to note damage on the Bill of Lading at the time of delivery is considered acceptance of the vehicle in good condition and waives your right to file a claim.

9. CHARGEBACKS AND DISPUTES

Customer acknowledges that the Broker Fee is payment for the service of locating a carrier. Customer agrees not to issue a chargeback or dispute the Broker Fee payment with their credit card issuer for any reason covered by these Terms, including delays, damage claims (which are the Carrier's responsibility), or cancellations made after carrier assignment. Any unauthorized chargebacks will be disputed using this signed agreement and may be sent to collections.

10. GOVERNING LAW

These Terms shall be governed by and defined following the laws of the State of Florida. You irrevocably consent that the courts of Florida shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless BH Home Solution Group (d/b/a Olympic Auto Transport), its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms and Conditions or your use of our services, including but not limited to any false information provided regarding the vehicle's condition.

12. FORCE MAJEURE

Olympic Auto Transport shall not be liable or responsible to you, nor be deemed to have defaulted or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control including, without limitation, acts of God, flood, hurricane, fire, earthquake, explosion, governmental actions, war, invasion or hostilities, terrorist threats or acts, riot, or other civil unrest, national emergency, revolution, insurrection, epidemic, lockouts, strikes or other labor disputes (whether or not relating to our workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage.

13. SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason by any court of competent jurisdiction, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
